Questa ipotesi specifica di giustificato motivo oggettivo di licenziamento è oggi contemplata in due differenti norme applicabili “ratione temporis” con riguardo alla data di assunzione del lavoratore: si tratta dell’art. 18 comma 7 della L. 300/70 (inidoneità sopravvenuta), e dall’art 2, 4 comma del D.Lgs. 23/2015 (disabilità sopravvenuta).
